Modificari importante la Legea Farmaciei

Ministrul Sanatatii, Cseke Attila, a prezentat, joi, proiectul de Ordonanta de Urgenta privind modificarea Legii Farmaciei nr. 266/2008. Potrivit noilor reglementari, o noua farmaciecomunitara, in mediul urban, se va putea deschide doar tinand cont de numarul de locuitori si va trebui sa fie la cel putin 500 de metri de alta farmacie.

"Modificarea Legii Farmaciei reprezinta o necesitate avand in vedere ca, la sfarsitul acestui an, inceteaza aplicabilitatea criteriului demografic privind infiintarea farmaciilor comunitare.

Renuntarea la acest criteriu ar duce la autorizarea fara limita a farmaciilor comunitare, iar in prezent, in Romania exista un numar suficient de farmacii prin care se asigura aprovizionarea cu medicamente a populatiei. Mai mult, daca eliminam acest criteriu, exista pericolul transferului farmaciilor din mediul rural in cel urban", a declarat ministrul Sanatatii jogos casino online.

In noua forma a Legii s-a eliminat exceptia infiintarii farmaciilor in centre comerciale, gari si aerogari. Prin exceptie de la criteriul demografic, vor mai putea fi deschise unitati farmaceutice doar pe o raza de 100 m de spitalele care au compartimente de permanenta sau unitati de primire urgente, cu conditia ca farmacia sa aiba orar permanent.

O alta prevedere introdusa in lege este aceea a serviciului de permanenta in unitatile farmaceutice. Asigurarea asistentei farmaceutice permanente a populatiei este obligatorie pentru minim o farmacie in localitatile cu cel putin 20 000 locuitori. Metolologia de functionare se va stabili, conform Ordinului ministrului, adoptat cu consultarea Colegiului Farmacistilor din Romania in termen de 60 de zile de la adoptarea Legii Bonus Fara Depunere

"Vreau sa va dau cateva exemple care justifica aceasta decizie. In judete ca Ilfov, Bistrita -Nasaud, Covasna, Gorj, Harghita, Ialomita nu exista nicio farmacie cu program permanent, in timp ce in judete ca Brasov, Galati, Alba, Olt, Satu Mare, Suceava, Vrancea sau Caras Severin exista doar o farmacie cu program permanent", a mai spus ministrul.

Conform noilor prevederi o farmacie va putea fi infiintata si va functiona ca societate comerciala in care farmacistul este asociat unic sau farmacistii detin cel putin 51% din actiuni.

Curtea de Justitie din Luxembourg, care s-a pronuntat in cauzele C-531/106 si C-171/07, privind detinerea si administrarea unei farmacii numai de catre farmacisti, a decis, in 19 mai 2009, ca fiecare stat membru poate adopta masuri care sa diminueze cat mai mult posibil riscul pentru sanatatea publica, inclusiv riscul pentru o aprovizionare sigura si de calitate a populatiei cu medicamente.

"Vrem sa ne asiguram ca farmaciile nu devin niste societati comerciale care urmaresc doar profit. Sigur ca si un farmacist are ca obiectiv obtinerea de profit. Dar, in calitate de farmacist profesionist, nu va administra farmacia in scop exclusiv economic, ci dintr-o perspectiva profesionala", crede ministrul Cseke Attila.

O alta prevedere importanta este aceea care se refera la functia de farmacist-sef. Daca pana in prezent farmacistul-sef conducea unitatea doar in baza unui certificat de membru al Colegiului Farmacistilor din Romania, conform noilor prevederi legale va putea deveni farmacist-sef doar farmacistul care va face dovada unei experiente de cel putin 2 ani in profesie. Acesta va avea dreptul de a conduce o singura unitate farmaceutica in care are si norma de baza.

De asemenea, in noua Lege va fi interzisa vanzarea pe Internet a medicamentelor de catre farmaciile comunitare. Masura urmareste realizarea calitatii actului farmaceutic. De asemenea, farmaciile si drogheriile vor fi obligate sa primeasca de la pacienti medicamentele expirate pentru a fi distruse in conditiile legii. Nerespectarea acestor prevederi vor reprezenta contraventii si vor fi sanctionate conform prevederilor legale.
